It requires online platforms to remove flagged NCII content within 48 hours of notice; that platform-compliance deadline (one year after enactment) has already passed, so the removal obligation is now current, enforceable law. This federal law is directly relevant to school settings where students may share or generate such images. The TAKE IT DOWN Act provides a federal remedy that is separate from and stackable with Maryland Crim. Law ss 3-809 (nonconsensual intimate image distribution). Schools should update their acceptable-use and digital citizenship policies to address NCII and AI-generated content consistent with both the federal Act and existing Maryland law.
