A septiembre de 2026, un «notario público» en Estados Unidos no es abogado y no puede darle consejo legal ni representarlo en un caso de inmigración. La regla federal 8 CFR 1292.1, junto con su regla paralela para el DHS, 8 CFR 292.1, limita quién puede representarlo ante las cortes de inmigración y el Departamento de Seguridad Nacional (DHS): abogados, representantes acreditados por el EOIR y unas pocas categorías muy limitadas.
Además, USCIS explica que usted no necesita un representante para presentar formularios: puede presentarlos por su cuenta. Esta página explica la diferencia entre un notario de América Latina y un notary public de Estados Unidos, cómo comprobar si la persona que lo ayuda está autorizada, qué dicen las leyes de 40 estados y el Distrito de Columbia, y cómo denunciar un fraude.

Qué es un «notario público» en Estados Unidos (y por qué no es lo mismo que en América Latina)
En muchos países de América Latina, el notario es un profesional del derecho con amplias facultades. En Estados Unidos, el notary public es un funcionario comisionado por el estado para tareas como certificar firmas y tomar juramentos. No es abogado por serlo.

USCIS lo explica así en su página de servicios legales:
Los «Notarios» o «notario público» son abogados con credenciales legales especiales en algunos países extranjeros. En Estados Unidos, los notarios públicos no son abogados y no pueden representarle en asuntos legales, incluidos los casos de inmigración.
Esa confusión de palabras es la base del llamado fraude de notario. Una persona se anuncia como «notario» o «consultor de inmigración», cobra por llenar formularios o por «arreglar papeles» y da consejos que no está autorizada a dar. El Programa de Prevención de Fraude y Abuso del EOIR describe estos casos como la práctica no autorizada de la ley de inmigración, que según su página oficial cometen con frecuencia notarios, consultores de inmigración o los llamados «agentes de viajes».
Por eso tantos estados prohíben que un notario que no es abogado use la palabra «notario» o traduzca literalmente su cargo al español. La tabla más abajo muestra esas leyes estado por estado.
Quién puede legalmente darle consejo o representarlo en un asunto de inmigración
La regla federal es 8 CFR 1292.1 («Representation of others»), que se modificó por última vez el 11 de febrero de 2022. Su párrafo (a) enumera quién puede representar a una persona ante el EOIR (las cortes de inmigración y la Junta de Apelaciones de Inmigración) y el DHS. La regla del DHS, 8 CFR 292.1, tiene una lista similar para asuntos ante el DHS, con algunas diferencias de detalle y una categoría más, los abogados fuera de Estados Unidos, en el párrafo (a)(6). Las cinco categorías de 8 CFR 1292.1(a) son:
- Abogados en Estados Unidos («Attorneys in the United States»). Una vez vigentes los requisitos de registro, el abogado debe estar registrado para ejercer ante el EOIR.
- Estudiantes y egresados de derecho que aún no son abogados, solo si actúan a petición de la persona, sin cobrarle y bajo la supervisión directa de un abogado o representante acreditado registrado ante el EOIR.
- Personas de buena reputación («reputable individuals») que actúan en un solo caso, sin cobrar, con una relación previa con la persona (por ejemplo, un familiar, vecino, religioso o amigo; el requisito puede dispensarse si no hay otra representación adecuada) y con permiso del funcionario ante quien comparecen. La regla excluye a quien se dedica habitualmente a trámites de inmigración o se presenta al público como capacitado para hacerlos.
- Representantes acreditados («Accredited representative»): personas que el EOIR autorizó a representar clientes en nombre de una organización reconocida y cuya acreditación está vigente. Un representante con acreditación parcial solo puede actuar ante el DHS. Uno con acreditación completa puede actuar ante el DHS y, una vez registrado, ante las cortes de inmigración y la Junta.
- Funcionarios acreditados («Accredited officials») del gobierno del país al que la persona debe lealtad, solo en su capacidad oficial y con el consentimiento de la persona.
Un notario público no aparece en esa lista. USCIS agrega en su página de servicios legales que un abogado extranjero con licencia puede representarlo solo en asuntos que ocurren fuera de Estados Unidos.
USCIS también explica qué puede hacer alguien que no está en esas categorías: puede darle ayuda limitada para llenar formularios de USCIS, pero no puede representarlo ni darle consejo legal, y solo puede cobrarle una tarifa nominal. USCIS recomienda revisar las reglas de su estado para saber qué servicios están permitidos allí.
Cómo verificar si su representante es legítimo
Hágalo antes de pagar o de entregar documentos. Estos son los pasos que indican las propias agencias:

- Representante acreditado u organización reconocida. El EOIR publica las listas de Reconocimiento y Acreditación: la lista de organizaciones reconocidas, la lista de representantes acreditados y una lista por estado (en PDF). Busque el nombre de la persona y el de la organización para la que trabaja.
- Profesionales sancionados. El EOIR mantiene una lista de profesionales actualmente sancionados. Si la persona aparece allí, puede tener prohibido ejercer ante las cortes de inmigración.
- Abogados. USCIS recomienda pedir al abogado su documento de licencia vigente y confirmar con la agencia estatal donde tiene licencia que puede ejercer el derecho. USCIS exige que el abogado sea miembro en regla del colegio de abogados de un estado, territorio o del Distrito de Columbia, y que no esté inhabilitado.
- Formulario G-28. Según USCIS, un abogado o representante acreditado que lo represente debe presentar el Formulario G-28 junto con su solicitud, y usted también lo firma para dar su consentimiento. Si alguien llena sus formularios y dice representarlo pero no presenta un G-28, pregunte por qué.
- Ayuda gratuita o de bajo costo. El EOIR publica una lista de proveedores de servicios legales gratuitos, organizada por estado.
Leyes estatales sobre consultores de inmigración y el uso del título «notario»
La ley federal define quién puede representarlo. Las leyes estatales regulan lo que puede hacer y anunciar quien no está en esa lista. Hay dos tipos principales:
- Leyes especiales de consultores de inmigración. Regulan a cualquier persona que ofrece servicios de inmigración sin ser abogado. Según el estado, exigen registro o licencia, un bono, un contrato por escrito, avisos visibles o una lista cerrada de servicios permitidos. Por ejemplo, California exige un bono de $100,000 antes de operar como consultor de inmigración; Utah exige registro y un bono o certificado de depósito de $50,000; Georgia exige una licencia de proveedor de asistencia de inmigración; e Illinois exige registro ante el procurador general con un seguro o un bono.
- Prohibiciones en la ley notarial. Muchos estados prohíben que el notario que no es abogado use «notario» o «notario público», traduzca literalmente «notary public» al español, se anuncie como experto en inmigración o cobre por representar a alguien en un proceso de inmigración.
Cómo leer la tabla: Sí en la tercera columna significa que la ley citada prohíbe a quien no es abogado usar «notario» o «notario público», o traducir literalmente «notary public». En la mayoría de los estados esa regla se dirige a los notarios; en otros, como Washington, Colorado y Nueva York, se dirige a cualquier persona que ofrece servicios de inmigración. Solo con el aviso exigido significa que la palabra se permite únicamente si el anuncio incluye la advertencia de que la persona no es abogado.

Algunos detalles importantes de la tabla:
- Texas. Para un notario, usar «notario» o «notario publico» en su publicidad es un delito menor de clase A, y pasa a ser un delito grave de tercer grado si la persona ya fue condenada antes bajo esa misma sección, según el Código de Gobierno § 406.017. La misma sección prohíbe al notario cobrar por representar a alguien en un proceso de inmigración.
- Wisconsin. Violar las prohibiciones de § 140.02(1)(i) puede costar una multa de hasta $10,000, hasta 9 meses de cárcel, o ambas; una segunda infracción o las siguientes pueden costar una multa de hasta $10,000, hasta 6 años de prisión, o ambas.
- Kansas. Usar «notario» siendo notario y no abogado es un delito menor de clase B y además una práctica engañosa bajo la ley de protección al consumidor, según K.S.A. 53-5a25.
- Nevada. El Secretario de Estado debe suspender al notario que viole la prohibición e imponer una multa civil de hasta $2,000 por cada violación, según NRS 240.085. Aparte, los servicios registrados de preparación de documentos no pueden usar en su publicidad términos como «notario», «notario publico» o «licenciado» que den a entender que son abogados, ni afirmar que tienen influencia especial ante la corte o la agencia, según NRS 240A.240.
- Oregón. Según ORS 9.280, actuar como consultor de inmigración a cambio de pago sin ser miembro activo del colegio de abogados de Oregón es ejercicio no autorizado del derecho, salvo para quienes la ley federal autoriza a representar personas ante el DHS o el Departamento de Justicia. En cuanto al título «notario», una persona perjudicada puede demandar por sus daños reales o $200, lo que sea mayor, según el capítulo ORS 194.
- Nueva Jersey. El consultor de inmigración que se presenta como abogado comete un delito de tercer grado, y retener a sabiendas los documentos de inmigración de otra persona por más de un tiempo razonable después de que los pida por escrito es un delito de cuarto grado, según N.J. Stat. § 2C:21-31.
Estados sin ley especial ni prohibición del título. En Alabama, Alaska, Hawái, Kentucky, Luisiana, Nuevo Hampshire, Dakota del Sur y Vermont, la ley notarial no incluye una prohibición del título «notario» y no hay una ley especial de consultores de inmigración. Eso no significa que el fraude sea legal allí: siguen vigentes las leyes generales contra el ejercicio no autorizado del derecho y contra las prácticas comerciales engañosas, como la prohibición del ejercicio no autorizado del derecho en el Código de Hawái § 605-14.
La tabla no incluye a Carolina del Norte ni a Misisipi. Si vive en uno de esos estados, consulte la oficina de protección al consumidor de su estado.
Señales de alerta
Estas señales vienen de las advertencias de USCIS y de las conductas que las leyes estatales prohíben. Una sola no prueba un fraude, pero todas justifican detenerse y comprobar quién es la persona.

- Se presenta como «notario», «consultor de inmigración» o «experto en inmigración» sin ser abogado ni representante acreditado. Varias leyes de la tabla prohíben exactamente esos títulos, por ejemplo en Florida y Washington.
- Dice tener contactos especiales en el gobierno. USCIS advierte que algunas personas y negocios fingen ser expertos en inmigración o dicen tener conexiones especiales con el gobierno. En Maryland y el Distrito de Columbia, un consultor de inmigración no puede afirmar que obtendrá favores especiales o que tiene influencia especial con departamentos federales como Seguridad Nacional, Trabajo, Estado o Justicia (Md. Com. Law § 14-3303; D.C. Code § 28-5302).
- Promete un resultado o un trámite rápido a cambio de dinero. USCIS pide cuidado con las ofertas de acelerar un caso por dinero y con las promesas de un beneficio rápido. En Utah es ilegal que un consultor de inmigración haga una garantía o promesa que no esté por escrito o que no tenga base en los hechos (Utah Code § 13-49-401).
- Le cobra por adelantado un servicio que todavía no hizo. Maryland y el Distrito de Columbia lo prohíben a los consultores de inmigración. En Colorado, que alguien que no es abogado pida o acepte por un pago un adelanto por servicios futuros en un asunto de inmigración, sobre todo si dependen de una reforma migratoria pendiente, es una práctica comercial engañosa (C.R.S. § 6-1-727).
- Elige por usted el formulario o le dice qué contestar. Eso es consejo legal. Michigan, por ejemplo, prohíbe al asistente de inmigración escoger el tipo de solicitud o formulario (MCL 338.3467).
- Se queda con sus documentos originales. Maryland y el Distrito de Columbia prohíben negarse a devolverlos cuando el cliente los pide, y en Nueva Jersey retenerlos a sabiendas por más de un tiempo razonable después de una petición escrita es un delito.
- Le pide transferir dinero a una persona o pagar tarifas de USCIS fuera de su cuenta myUSCIS. USCIS advierte que los estafadores se hacen pasar por funcionarios del gobierno y pide desconfiar de solicitudes, supuestamente de USCIS, para transferir dinero a una persona o pagar tarifas por otro medio que no sea su cuenta myUSCIS.
Qué hacer si fue víctima de un notario o consultor falso
Denunciar ayuda a detener al estafador. USCIS indica que denunciar una estafa cometida por otra persona, en la mayoría de los casos, no afecta negativamente su solicitud si usted no participó en ella.
- Reúna pruebas. El EOIR menciona como ejemplos recibos, contratos o acuerdos de servicios y anuncios. Guarde también mensajes, tarjetas de presentación y copias de lo que se presentó en su nombre.
- Denuncie ante la FTC. La Comisión Federal de Comercio recibe denuncias de estafas de inmigración en español en ReporteFraude.ftc.gov, en inglés en ReportFraud.ftc.gov y en otros idiomas al (877) 382-4357, opción 3, según su página sobre estafas contra inmigrantes.
- Denuncie ante el EOIR. El Programa de Prevención de Fraude y Abuso acepta denuncias por correo electrónico a EOIR.Fraud.Program@usdoj.gov. Si la queja es contra un abogado o un representante acreditado, también puede usar el formulario EOIR-44, disponible en inglés y en español en la página del Programa de Disciplina de Abogados. USCIS publica además el teléfono del programa, 877-388-3840, en su página para evitar estafas.
- Denuncie en su estado. USCIS recomienda denunciar la estafa ante la oficina estatal de protección al consumidor y, si perdió dinero u otras pertenencias, también ante la policía local, según su página para reportar estafas de inmigración.
- Busque ayuda legítima para su caso. Si alguien presentó documentos en su nombre, pida a un abogado o representante acreditado que revise su expediente y cualquier fecha límite pendiente. Puede empezar por la lista de proveedores gratuitos del EOIR o las listas de representantes acreditados.

¿Un notario público puede ayudarme con mi caso de inmigración?
Un notario público de Estados Unidos puede certificar firmas, pero no es abogado. USCIS dice que los notarios públicos no pueden representarlo en asuntos legales, incluidos los casos de inmigración. Solo puede representarlo alguien de la lista de 8 CFR 1292.1 (o de su regla paralela para el DHS, 8 CFR 292.1), como un abogado o un representante acreditado por el EOIR.
¿Necesito un abogado para presentar formularios ante USCIS?
No. USCIS dice que usted no necesita un representante para presentar formularios y que puede presentarlos por su cuenta. Si decide tener un representante, USCIS recomienda que sea un abogado o un representante acreditado que trabaje para una organización reconocida por el Departamento de Justicia.
¿Qué es un representante acreditado?
Es una persona que no es abogado pero que el EOIR autorizó a representar clientes en nombre de una organización reconocida, con una acreditación vigente. La acreditación parcial permite actuar solo ante el DHS; la completa permite actuar también ante las cortes de inmigración y la Junta de Apelaciones de Inmigración, una vez registrado.
¿Cómo compruebo si un representante acreditado es real?
Busque su nombre y el de su organización en las listas de Reconocimiento y Acreditación que publica el EOIR en justice.gov/eoir/recognition-accreditation-roster-reports. También puede revisar la lista del EOIR de profesionales actualmente sancionados.
¿Puede un consultor de inmigración llenar mis formularios?
Depende del estado y de lo que haga. USCIS dice que quien no es abogado ni representante acreditado puede dar ayuda limitada para llenar formularios, sin representarlo ni darle consejo legal, y solo cobrando una tarifa nominal. Varios estados, como California, Illinois y Carolina del Sur, fijan qué servicios puede ofrecer y exigen registro, licencia, avisos o un bono.
¿Dónde denuncio a un notario o consultor falso?
Puede denunciar ante la FTC en ReporteFraude.ftc.gov, ante el Programa de Prevención de Fraude del EOIR en EOIR.Fraud.Program@usdoj.gov (o con el formulario EOIR-44 si la queja es contra un abogado o representante acreditado) y ante la oficina de protección al consumidor de su estado. Si perdió dinero, USCIS recomienda denunciarlo también a la policía local.
¿Denunciar una estafa afecta mi caso de inmigración?
USCIS indica que denunciar una estafa cometida por otra persona, en la mayoría de los casos, no afecta negativamente su solicitud si usted no participó en ella.
¿En qué estados es ilegal usar el título «notario»?
En 35 de las 41 jurisdicciones de la tabla de esta página, la ley prohíbe a quien no es abogado usar «notario» o «notario público», o traducir literalmente «notary public». En Arkansas, Connecticut y Wisconsin la palabra solo se permite con el aviso de que la persona no es abogado.

(a) (1) Prior to engaging in the business, or acting in the capacity, of an immigration consultant, each person shall file with the Secretary of State a bond of one hundred thousand dollars ($100,000) executed by a corporate surety admitted to do business in this state and conditioned upon compliance with this chapter. The total aggregate liability on the bond shall be limited to one hundred thousand dollars ($100,000). (2) The bond may be terminated pursuant to Section 995.440 of, and Article 13 (commencing with Section 996.310) of Chapter 2 of Title 14 of Part 2 of, the Code of Civil Procedure. (b) The bond required by this section shall be in favor of, and payable to, the people of the State of California and shall be for the benefit of any person damaged by any fraud, misstatement, misrepresentation, unlawful act or omission, or failure to provide the services of the immigration consultant or the agents, representatives, or employees of the immigration consultant, while acting within the scope of that employment or agency.

(a) Every notary public who is not an attorney who advertises the services of a notary public in a language other than English by signs or other means of written communication, with the exception of a single desk plaque, shall post with that advertisement a notice in English and in the other language which sets forth the following: (1) This statement: I am not an attorney and, therefore, cannot give legal advice about immigration or any other legal matters. (2) The fees set by statute which a notary public may charge. (b) The notice required by subdivision (a) shall be printed and posted as prescribed by the Secretary of State. (c) Literal translation of the phrase “notary public” into Spanish, hereby defined as “notario publico” or “notario,” is prohibited. For purposes of this subdivision, “literal translation” of a word or phrase from one language to another means the translation of a word or phrase without regard to the true meaning of the word or phrase in the language which is being translated. (d) The Secretary of State shall suspend for a period of not less than one year or revoke the commission of any notary public who fails to comply with subdivision (a) or (c).

(1) A person may not obtain or use a notary public commission in other than his or her legal name, and it is unlawful for a notary public to notarize his or her own signature. Any person applying for a notary public commission must submit proof of identity to the Department of State. Any person who violates this subsection commits a felony of the third degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084. (2)(a) The fee of a notary public may not exceed $10 for any one notarial act under this part, except as provided in s. 117.045 or s. 117.275. (b) A notary public may not charge a fee for witnessing a vote-by-mail ballot in an election, and must witness such a ballot upon the request of an elector, provided the notarial act is in accordance with the provisions of this chapter. (3)(a) A notary public seal shall be affixed to all notarized paper documents and shall be of the rubber stamp type and shall include the words “Notary Public-State of Florida.” The seal shall also include the name of the notary public, the date of expiration of the commission of the notary public, and the commission number.

(b) Engage in the unauthorized practice of law as determined by a court of competent jurisdiction. (c) Represent that services he or she offers or provides are legal advice or legal services. (d) Falsely represent that services he or she offers or provides are necessary. (e) Falsely represent that services he or she offers or provides are in response to a request by or on behalf of a consumer. (f) Represent that the life, safety, or welfare of the consumer and his or her family would be adversely affected if the services of an immigration clerical assistant are not provided. (g) Fail to reveal a material fact regarding an immigration matter or regarding services that could not be reasonably known to the consumer, the omission of which tends to mislead or deceive the consumer.

§ 406.017REPRESENTATION AS ATTORNEYVigente
(a) A person commits an offense if the person is a notary public and the person: (1) states or implies that the person is an attorney licensed to practice law in this state; (2) solicits or accepts compensation to prepare documents for or otherwise represent the interest of another in a judicial or administrative proceeding, including a proceeding relating to immigration or admission to the United States, United States citizenship, or related matters; (3) solicits or accepts compensation to obtain relief of any kind on behalf of another from any officer, agency, or employee of this state or the United States; (4) uses the phrase "notario" or "notario publico" to advertise the services of a notary public, whether by signs, pamphlets, stationery, or other written communication or by radio or television; or (5) advertises the services of a notary public in a language other than English, whether by signs, pamphlets, stationery, or other written communication or by radio or television, if the person does not post or otherwise include with the advertisement a notice that complies with Subsection (b).

(1) A nonattorney notary may not provide advice or counsel to another person concerning legal documents or legal proceedings, including immigration matters. (2) (a) (i) A nonattorney notary who advertises notarial services in any language other than English shall include in the advertisement a notice that the notary public is not an attorney. (ii) The notice under Subsection (2)(a)(i) must include the fees that a notary may charge pursuant to Section 46-1-12 and the following statement:"I AM NOT AN ATTORNEY LICENSED TO PRACTICE LAW IN UTAH AND MAY NOT GIVE LEGAL ADVICE ABOUT IMMIGRATION OR ANY OTHER LEGAL MATTER OR ACCEPT FEES FOR LEGAL ADVICE." (b) (i) The notice required by Subsection (2)(a) shall be in English and in the language of the advertisement and in letters of a conspicuous size. (ii) If the advertisement is by radio or television, the statement may be modified, but must include substantially the same message. (c) (i) Literal translation of the phrase "Notary Public" into any language other than English is prohibited if the literal translation implies that the notary is a licensed attorney.

A. A notary public shall not offer or provide legal advice on immigration or other legal matters, or represent any person in immigration proceedings, unless such notary public is authorized or licensed to practice law in the Commonwealth or is accredited pursuant to 8 C.F.R. § 292.2 to practice immigration law or represent persons in immigration proceedings. B. A notary public shall not assume, use, or advertise the title of "notario," "notario publico," or "licenciado," or a term in a language other than English that indicates in such language that the notary is authorized to provide legal advice or practice law, unless such notary public is authorized or licensed to practice law in the Commonwealth. C. Whenever the Attorney General has reasonable cause to believe that any person has engaged in, is engaging in, or is about to engage in any violation of this section, the Attorney General may issue a civil investigative demand. The provisions of § 59.1-9.10 shall apply mutatis mutandis to a civil investigative demand issued pursuant to this section. D.

§ 140.02Notaries.Vigente
(1) Notaries public who are not attorneys. (a) The department shall appoint notaries public who shall be United States residents and at least 18 years of age. Applicants who are not attorneys shall file an application with the department and pay a $20 fee. (b) The department shall satisfy itself that the applicant has the equivalent of an 8th grade education, is familiar with the duties and responsibilities of a notary public and, subject to ss. 111.321, 111.322 and 111.335, does not have an arrest or conviction record. (c) If an application is rejected the fee shall be returned. (d) Qualified applicants shall be notified by the department to take and file the official oath and execute and file an official bond in the sum of $500, with a surety executed by a surety company and approved by the department. (e) The qualified applicant shall file his or her signature, post-office address, and an impression or imprint on a tangible record of his or her official stamp, with the department.

(a) A commission as a notary public does not authorize an individual to: (1) Assist persons in drafting legal records, give legal advice or otherwise practice law; (2) Act as an immigration consultant or an expert on immigration matters; (3) Represent a person in a judicial or administrative proceeding relating to immigration to the United States, United States citizenship or related matters; or (4) Receive compensation for performing any of the activities listed in this subsection. (b) A notary public may not engage in false or deceptive advertising. (c) A notary public, other than an attorney licensed to practice law in this state, may not use the term “notario” or “notario publico”. (d) A notary public, other than an attorney licensed to practice law in this state, may not advertise or represent that the notary public may assist persons in drafting legal records, give legal advice, or otherwise practice law.
