¿Cuál es la diferencia entre un acta de nacimiento original y un acta de nacimiento regular?

El acta de nacimiento original (OBC) es el registro presentado al nacer, que nombra a los padres biológicos; se sella una vez que se finaliza la adopción. El acta regular (enmendada), emitida al momento de la finalización, nombra a los padres adoptivos y es el acta que la mayoría de las personas adoptadas ya tiene y puede solicitar como cualquier otra persona.

¿Puedo obtener mis registros de adopción si mi estado exige una orden judicial?

Por lo general sí, pero no directamente ante una oficina de registros vitales. Un estado restringido exige presentar una petición ante el tribunal que finalizó la adopción, típicamente demostrando «good cause» (causa justificada), antes de que el tribunal ordene la divulgación. La información de antecedentes no identificativa a menudo está disponible por separado, sin orden judicial, incluso en los estados restringidos.

¿Todos los estados tienen un registro de reencuentro de adopción?

No. Varios estados, incluidos Alabama, Alaska, Kansas y Wyoming, no tienen ningún registro estatal de consentimiento mutuo, a menudo porque el acceso directo al OBC ya lo vuelve prácticamente redundante. Fui adoptado desde otro país. ¿Esto aplica a mi caso?

No. La ley estatal de registros de adopción, incluido todo lo que aparece en este hub, rige las adopciones nacionales en las que se presentó un acta de nacimiento ante un estado de EE. UU. Una adopción internacional, en cambio, se rige por la ley federal de inmigración y ciudadanía, y las preguntas sobre ese proceso normalmente involucran a U.S. Citizenship and Immigration Services, no a una oficina estatal de registros vitales.

¿Existe una única base de datos nacional de registros de adopción?

No. No existe un registro federal de registros de adopción. El International Soundex Reunion Registry (ISRR) es un registro privado, sin fines de lucro, de consentimiento mutuo, que funciona de manera independiente de cualquier gobierno estatal y puede complementar el registro propio de un estado, pero no es una fuente oficial del gobierno.

¿Por qué algunos estados fijan la edad por encima de los 18 años para las solicitudes de registros de adopción?

Cada estado fija su propio umbral por ley, y varios lo colocan por encima de los 18: Luisiana exige 24, Nebraska exige 25, y Maryland, Delaware y Arkansas exigen 21. Siempre confirme la edad aplicable directamente en la página del estado específico, ya que asumir que es 18 es una fuente común de error.

¿El modelo de acceso de un estado también aplica al expediente judicial de la adopción, o solo al acta de nacimiento?

Por lo general, solo al acta de nacimiento. Un estado puede otorgar acceso directo al acta de nacimiento original y, al mismo tiempo, mantener el expediente judicial de adopción por separado (es decir, la petición, el decreto y los documentos relacionados) sellado bajo un estándar de «good cause» (causa justificada) distinto, a menudo más estricto. Alabama, Georgia y Massachusetts son ejemplos de esta división.
