Idaho Car Seat Laws: Requirements and Guidelines

Frequently Asked Questions

At what age can a child stop using a car seat in Idaho?

Idaho law requires children 6 years old and younger to use a child safety restraint. Children 7 and older must wear a seat belt. However, the Idaho Transportation Department recommends that children continue using a booster seat until age 8 or until they are 4 feet 9 inches tall and can pass the seat belt fit test.

What is the fine for a car seat violation in Idaho?

A prior Idaho Supreme Court infraction fee schedule put the fixed penalty at $27.50, with total fines reaching around $84 once court costs and fees are included. That schedule is no longer posted at its previous web address, so confirm the current total with the court before relying on it. Idaho enforces car seat laws as a primary offense.

When can a child sit in the front seat in Idaho?

Idaho law does not set a specific minimum age for front seat use. Children 7 and older who are wearing a seat belt may legally sit in the front. However, the Idaho Transportation Department recommends that all children ride in the back seat until at least age 13 because front passenger airbags are designed for adults.

Does Idaho require rear-facing car seats?

Idaho's statute requires an appropriate child restraint for children 6 and under but does not specify a rear-facing mandate by age. The Idaho Transportation Department follows the AAP recommendation that children ride rear-facing until at least age 2 or until they exceed the manufacturer's height and weight limits for the rear-facing position.

Are taxis exempt from Idaho car seat laws?

Yes. Taxicabs are exempt from Idaho's child restraint requirements. Additionally, if all available seat belts are occupied by other children, a child may ride in the rear seat unrestrained; Idaho Code 49-672(2)(a) does not require another passenger to hold the child in that situation (a separate exemption covers a child temporarily removed from a restraint and held by an attendant for nursing or another immediate physiological need). Vehicles manufactured before January 1, 1966, without original seat belts are also exempt.

Updates

Fixed a conflated exemption (the seat-belts-occupied exemption does not require another passenger to hold the child; only the separate nursing/immediate-needs exemption does) and removed a dead citation for the $27.50/$56.50/$84 fine figures, which we could not re-verify against a current live source and have hedged accordingly.
