Oregon AI Laws and Regulation (2026)

Frequently Asked Questions

Does Oregon have an AI law?

Yes. Oregon has enacted several AI-related laws. SB 1571 (2024), codified at ORS 260.268, requires disclosure of synthetic media in political campaign communications, with exclusions for satire, parody, and paid broadcasters and platforms. HB 2299 (2025, effective January 1, 2026) criminalizes AI-generated intimate image deepfakes. HB 2748 (2025) bans AI from using nursing titles. SB 1546 (2026, signed into law as Chapter 85, Oregon Laws 2026, effective January 1, 2027) regulates AI companion chatbots with a private right of action.

What are the penalties for AI deepfakes in Oregon?

Under HB 2299 (ORS 163.472), distributing AI-generated intimate images without consent is a Class A misdemeanor, carrying up to one year in jail and a fine exceeding $6,000. Repeat offenders face Class C felony charges with up to five years in prison. Victims can also pursue civil damages. For political deepfakes, SB 1571 (ORS 260.268) allows a court to impose a civil penalty of up to $10,000 per violation when a campaign communication includes synthetic media without the required disclosure. Satire and parody are excluded from that requirement.

What does Oregon's AI chatbot law (SB 1546) require?

SB 1546 (signed into law March 31, 2026, as Chapter 85, Oregon Laws 2026, effective January 1, 2027) requires AI companion operators to disclose AI involvement, detect and intervene in expressions of suicidal ideation, maintain documented safety protocols, and file annual reports with the Oregon Health Authority. For minors, operators must provide hourly AI reminders, block sexually explicit content, and avoid creating emotional dependency. Violations carry $1,000 in statutory damages per incident through a private right of action.

Can AI call itself a nurse in Oregon?

No. Oregon is the first state in the nation to prohibit AI and nonhuman entities from using nursing titles. Under HB 2748 (effective January 1, 2026), AI systems cannot use titles such as Registered Nurse (RN), Licensed Practical Nurse (LPN), Advanced Practice Registered Nurse (APRN), or other protected nursing designations. The law was prompted by concerns about AI products marketed as capable of performing nursing tasks.

How does the Oregon Attorney General regulate AI?

The Oregon Attorney General published formal AI guidance in December 2024 clarifying that existing state laws apply to AI systems. This includes the Unlawful Trade Practices Act (consumer protection), the Oregon Consumer Privacy Act (data privacy and consent), the Oregon Consumer Information Protection Act (data security), and the Oregon Equality Act (anti-discrimination). Companies using AI must comply with all of these laws, including obtaining consent for sensitive data use in AI training and allowing consumers to opt out of AI profiling.

Updates

Corrected the statute citation for Oregon's campaign synthetic-media disclosure law to ORS 260.268 (SB 1571 was previously cited as ORS 260.345), narrowed the description of what the law actually covers, and added its five statutory exclusions, including satire and parody.

Updated SB 1546 (Oregon's AI companion chatbot law) from 'awaiting governor's signature' to its actual status: Governor Kotek signed it March 31, 2026, and it is now Chapter 85, Oregon Laws 2026, effective January 1, 2027. Corrected across the key takeaways, section header, body, summary table, and two FAQ answers.
