Does Nebraska have a comprehensive AI regulation law?

No. Nebraska has not enacted comprehensive AI regulation. LB 642, the Artificial Intelligence Consumer Protection Act, was introduced in 2025 and would have regulated high-risk AI systems, but it never advanced out of the Judiciary Committee and was indefinitely postponed on April 17, 2026. Nebraska has instead taken a targeted approach, enacting laws on AI-generated child exploitation material, nonconsensual deepfake intimate images, and AI use in health insurance decisions.

Is AI-generated child sexual abuse material illegal in Nebraska?

Yes. LB 383, signed by Governor Pillen on May 20, 2025, and effective January 1, 2026, criminalizes the possession, creation, and distribution of AI-generated child sexual abuse material. For adults 19 and older, possession is a Class IIA felony carrying up to 20 years in prison. A defendant with a prior conviction for a covered offense faces a Class IC felony with a mandatory minimum of five years and a maximum of 50 years, except that a second or subsequent offense by a defendant under 19 remains a Class IV felony.

Can health insurers in Nebraska use AI to deny claims?

AI cannot be the sole basis for denying, delaying, or modifying health care services in Nebraska. LB 77, the Ensuring Transparency in Prior Authorization Act, took effect January 1, 2026. The law requires that adverse determinations involve a physician review and prohibits reliance on AI alone. It also mandates standardized prior authorization forms and clear review timelines.

What legal options exist for victims of deepfake intimate images in Nebraska?

LB 371, signed on May 30, 2025, provides civil remedies for victims of nonconsensual AI-generated intimate images. The law amends the Uniform Civil Remedies for Unauthorized Disclosure of Intimate Images Act to cover computer-generated and digitally manipulated images.
