Imputation does not apply when a parent stopped working because of injury, illness, layoff, or other involuntary circumstances.

How to Modify Child Support in Pennsylvania

Pennsylvania allows parents to request a modification of child support at any time there is a material and substantial change in financial circumstances.

23 Pa.C.S. 4354 defines willful failure to pay a court-ordered support obligation as a criminal offense when the person has the financial ability to comply.

Grading and penalties for criminal nonsupport:

Under 23 Pa.C.S. 4354(d), the offense is graded as a summary offense by default, punishable by up to 90 days in jail under 18 Pa.C.S. 1105. It escalates to a misdemeanor of the third degree (up to 1 year in jail under 18 Pa.C.S. 1104) only if the person established residence outside Pennsylvania with the intent of not complying with the support order, and either the offense is a second or subsequent offense under the section, or the person owes support equal to or greater than 12 months of the monthly obligation. Pennsylvania law does not create a second-degree or first-degree misdemeanor tier for this offense.

Civil contempt penalties are set by 23 Pa.C.S. 4345(a), which allows any one or more of the following: imprisonment for a period not to exceed six months, a fine not to exceed $1,000, and probation for a period not to exceed one year. When Does Child Support End in Pennsylvania?

Termination Process

Exceptions to Termination

Child support may continue beyond age 18 in these situations:
