How Pennsylvania Calculates Child Support

  • Pennsylvania uses the Income Shares model under 231 Pa. Code Rule 1910.16-3, combining both parents' monthly net incomes to determine the basic child support obligation.
  • The basic obligation is determined from a schedule table and each parent's share is proportional to their percentage of the combined net income.
  • Shared custody applies when the obligor has 40% or more overnights per year (146+ nights — 40% of 365). Under Rule 1910.16-4(c), the reduction scales proportionally above the 40% threshold. The guidelines schedule already assumes the obligor has the child ~30% of the time (~109 nights); the shared parenting adjustment only applies when custody exceeds 40%.
