Does Alaska Have an Age Verification Law? (2026 Update)

As of August 2026, Alaska has not enacted a law requiring adult websites to verify a visitor's age. Two bills came close, but neither survived the legislative process, and Alaska residents can currently reach adult content the same way residents of any other no-law state can.

Has Alaska Considered an Age-Verification Law?

Alaska has considered age verification in two separate bills, and both ultimately failed.

House Bill 254, introduced during the 2023-2024 session, would have required a commercial entity that intentionally publishes pornography to use a commercially reasonable age-verification method before granting access, and would have barred the verifier from retaining the data collected. The bill passed the House 33-6 (1 excused) on April 26, 2024. HB 254 was then referred to the Senate Judiciary Committee on May 6, 2024, and died there without a floor vote when the session adjourned on May 16, 2024. An amendment added during House passage would also have banned social media use by children under 14 and required parental consent for users under 16; that language died with the same bill.

House Bill 47 came closer than any other Alaska measure. As reported out of the House Judiciary Committee on February 2, 2026, the bill dealt only with AI-generated child sexual abuse material, forged digital likenesses, and related offenses, and it contained no age-verification language. House floor amendments adopted on February 25, 2026 attached a new Alaska Social Media Regulation Act, which would have required a social media platform to "verify the age of each user of the platform in the state," obtain written parental consent before a minor could create or maintain an account, give consenting parents access to the minor's account, bar advertising and targeted content aimed at minor users, and block minors from the platform between 10:30 p.m. and 6:30 a.m. unless a parent changed those hours. The House passed the amended bill, CSHB 47(JUD) am, 39-0 with one member excused on February 27, 2026. The Senate Community and Regional Affairs Committee then produced a substitute that removed the social media article entirely; that version, SCS CSHB 47(CRA), was reported out with a new title on April 10, 2026, and the bill went no further than the Senate Judiciary Committee before the session ended.

House Bill 239, the 2026 omnibus crime package, is frequently confused with HB 47 because both cleared the Alaska House 39-0 with one member excused during the same session. HB 239 became law without the governor's signature on June 18, 2026 as chapter 9, SLA 2026. It criminalizes generated obscene child sexual abuse material and expands Alaska's sexual-abuse-of-a-minor offenses to reach 16- and 17-year-old victims in specified relationships, but no version of the bill, from introduction through the enrolled text, contained an age-verification or social media requirement.

Where This Leaves Alaska Residents

No federal law requires adult websites to verify a visitor's age. The Supreme Court's 2025 decision in Free Speech Coalition v. Paxton confirmed that states may enact this kind of law and have it survive a First Amendment challenge under intermediate scrutiny, but that decision does not require any state to act, and Alaska has not.

Because Alaska has no statute creating a legal trigger, mainstream adult websites generally do not geo-block Alaska visitors the way some have blocked residents of Texas, Louisiana, Utah, and other states with enacted verification requirements. A visitor in Alaska can currently reach the same content as a visitor in any other no-law state, without an ID check.
