How much does baja laboral pay in Spain?

For enfermedad común or accidente no laboral, the subsidio equals 60 percent of the base reguladora from day 4 through day 20, rising to 75 percent from day 21 onward. Days 1 to 3 carry no statutory Social Security payment by default, unless a convenio colectivo covers them. Accidente de trabajo and enfermedad profesional use a different calculation.

Who pays my salary during the first days of sick leave in Spain?

Nobody, by statutory default, for the first 3 days of an enfermedad común or accidente no laboral process, unless a convenio colectivo says otherwise. The employer pays days 4 to 15 directly. From day 16 onward, the INSS or the mutua pays, usually still processed through the employer's payroll.

Do I still have to hand in my parte de baja to my employer?

No, not since 1 April 2023. Under Real Decreto 1060/2022, the doctor's office transmits the parte electronically to the INSS, and the INSS notifies the employer. The worker's own obligation is simply to keep the copy the doctor provides.

How long can incapacidad temporal last in Spain?

Up to 365 días, extendable by a further 180 días de prórroga if recovery is still expected within that extra window (art. 169 LGSS). Up to the 365-day mark the INSS shares medical-discharge powers with the regional health service; after that, only the INSS's own medical inspection can issue the alta.

Is my job protected while I am on baja laboral?

Yes. Incapacidad temporal suspends the contract rather than ending it (art. 45.1.c ET), and once the IT process closes, you have the right to return to your reserved job (art. 48.1 ET). A special rule extends job reservation for two more years only in the specific case where IT converts into a foreseeably reversible incapacidad permanente.
