Can I order a Montana marriage certificate from the state?

No. The Office of Vital Records states that it does not issue marriage and divorce records and holds only a searchable index. Official certificates and decrees can only be issued by the Clerk of District Court in the county where the event was filed.

What does Montana's index search actually give me?

Verification that the event was recorded and the identity of the county holding the record. It does not provide a certified copy of the certificate. It costs $10.00 for a search covering up to 5 years, plus $1.00 for each additional year.

Which Montana county holds my marriage record?

The county where you bought the license, not the county where the ceremony took place. DPHHS puts it this way: if you bought your license in Lewis and Clark County but held the ceremony in Cascade County, your record remains in Lewis and Clark County. If nobody remembers which county issued the license, the $10 state index search will identify it.

How far back does the Montana index go?

1943 to the present. Marriages and divorces before 1943 were never indexed at the state level and remain with the Clerk of District Court in the county where they were filed.

Are Montana marriage records public?

Only in part, and only after time passes. MCA 50-15-122 limits what may be disclosed from a marriage filing to a defined list of fields, and provides that the information in a marriage license and certificate may be released to the public 30 years after the date of the marriage.

Are Montana divorce records public?

Generally yes. MCA 50-15-122(5)(e) provides that once a record of dissolution of marriage is filed with the clerk of the district court, it may be released to the public without restriction unless the court designated it confidential.

Can I order a Montana index search online?

Not through a channel Montana names on its own pages. The published route is a mailed Application for Search of Marriage and Divorce Indexes sent to Montana Vital Records in Helena, typically processed within 7 to 10 business days after arrival.
