Yes. ADPH states that marriage certificates are unrestricted under Alabama law and may be requested by anyone who can provide enough information to search for the record and pay the fee. How much does an Alabama marriage or divorce certificate cost?

As of August 2026, ADPH charges a $15.00 search fee that includes one certified copy or a Certificate of Failure to Find. Additional copies of the same record ordered at the same time are $6.00 each, and expediting adds $15.00. Circuit clerks set their own separate fees for certified copies of a divorce decree, and those vary by county.

What if the marriage happened before 1936?

The state has no record of it. The Alabama Center for Health Statistics began filing marriage certificates in August 1936. For an earlier marriage, the county probate office where the license was issued is the custodian, and the Alabama Department of Archives and History can help identify what survives for that county.

Where do I get the actual Alabama divorce decree, not just the certificate?

From the circuit court in the county that granted the divorce. The ADPH divorce certificate confirms the fact of the divorce but contains none of the terms. Anything involving property division, custody, support, or enforcement requires the decree from the circuit clerk.

Are Alabama divorce records public?

The state divorce certificate is unrestricted by ADPH's own description. The underlying court file is a circuit court record and is generally available through the clerk, though a judge can seal all or part of a specific file by order in an individual case. If a clerk restricts a file, ask which order applies rather than assuming a statewide rule.

How long does an ADPH request take?

Processing time depends on channel and volume, and ADPH publishes current timeframes rather than a fixed guarantee. In-person requests at a county health department are the fastest route, mail is the slowest, and the $15.00 expedite fee moves a mail request forward. Confirm current timing with ADPH before relying on a deadline.

Do I need to prove I am related to the couple?

No. Alabama does not impose a relationship or tangible-interest test for marriage or divorce certificates, unlike its treatment of some other record types and unlike many other states. What you do need is enough identifying information for the office to locate the record.
