Wyoming E-Scooter Laws: Sidewalk, Helmet & Age Rules (2026)

Are e-scooters legal in Wyoming?

Wyoming has not written a dedicated "electric scooter" statute. The device category that a stand-up e-scooter falls into is "motorized skateboard," defined at Wyoming Statutes § 31-1-101(a)(xxix) as "a self-propelled device which has a motor or engine, a deck on which a person may ride and at least two (2) wheels in contact with the ground and which is not otherwise defined in this act as a 'motor vehicle', 'motorcycle', 'electric bicycle', 'motor-driven cycle' or 'pedestrian vehicle'." A stand-up electric scooter fits this catch-all definition.

Wyoming's separate "moped" category does not cover an e-scooter either: a moped requires foot pedals for muscular propulsion, which a stand-up e-scooter does not have.

What counts as an e-scooter in Wyoming

A motorized skateboard, by definition, is a self-propelled device with a motor, a deck to stand on, and at least two wheels, that does not otherwise fit Wyoming's definitions of motor vehicle, motorcycle, electric bicycle, motor-driven cycle, or pedestrian vehicle. Because "motorized skateboard" is explicitly excluded from Wyoming's "motor vehicle" definition (§ 31-1-101(a)(xv): "'Motor vehicle' means every vehicle which is self-propelled except vehicles moved solely by human power, electric bicycles or motorized skateboards"), the general vehicle titling and registration chapters, which key off "motor vehicle," do not apply to it.

Where you can ride

Wyoming Statutes § 31-5-120, "Driving upon sidewalk," bars any non-human-powered vehicle from a sidewalk except at a driveway crossing: "No person shall drive any vehicle except motorized wheelchairs other than by human power upon a sidewalk or sidewalk area except upon a permanent or duly authorized temporary driveway." The traffic act defines "vehicle" at § 31-5-102(a)(lviii) as "every device, in, upon, or by which any person or property is or may be transported or drawn upon a highway, except devices used exclusively upon stationary rails or tracks." That definition carves out only rail devices, so it plainly reaches a motorized skateboard. What keeps a bicycle off the sidewalk ban is not the definition of "vehicle" but § 31-5-120's own words, "other than by human power." A motorized skateboard is motor-driven, so it is barred from sidewalks statewide unless a local ordinance authorizes otherwise. The human-power exclusion that some summaries attach to this rule belongs to Wyoming's other "vehicle" definition, § 31-1-101(a)(xxvi), which governs the registration and titling chapters rather than the traffic act. No scooter-specific sidewalk carve-out exists in state law.

That "unless a local ordinance authorizes otherwise" qualifier has a statutory basis worth naming. Section 31-5-108 makes the traffic act "applicable and uniform throughout this state," then adds that "[l]ocal authorities may, however, adopt by ordinance, traffic regulations for all streets within their city limits and highways under their corporate jurisdiction." Section 31-5-109(a)(xvii) is more pointed: the act does not prevent local authorities from "[r]egulating persons upon skates, coasters, sleds, motorized skateboards and other toy vehicles." That is the only operative provision in Title 31 that names a motorized skateboard at all. Every other mention is definitional. In other words, the legislature defined the device and then left its regulation to municipalities, which is why the practical answer in Wyoming is to check your city's code.

Rider rules

• Age: No statewide age minimum for operating a motorized skateboard was found in the definitions or traffic-regulation sections searched for this research. This is an absence of a located requirement, not a statute affirmatively stating there is no minimum age.
• Helmet: No statewide helmet mandate for motorized skateboards was found in the sections searched.
• License, registration, insurance: Not required under the general vehicle chapters, since a motorized skateboard is excluded from Wyoming's "motor vehicle" definition.

A note on DUI and e-scooters

Wyoming's driving-under-the-influence statute, § 31-5-233(b), applies to anyone who drives or has "actual physical control of any vehicle within this state." The traffic act defines "vehicle" at § 31-5-102(a)(lviii) as "every device, in, upon, or by which any person or property is or may be transported or drawn upon a highway, except devices used exclusively upon stationary rails or tracks." Rail devices are the only exclusion, so a motorized skateboard falls inside the term. Based on this plain statutory text, Wyoming's DUI law likely does reach an e-scooter rider. This is the opposite outcome from neighboring Montana, where the DUI statute is keyed to the narrower "motor vehicle" term, which affirmatively excludes motorized scooters. No Wyoming court decision or attorney general opinion confirming this specific reading was found this session, so treat it as a statutory-text-level finding rather than settled case law, and do not treat riding impaired as a lesser risk because of any ambiguity.

Cheyenne e-scooter rules

Cheyenne's municipal code includes Chapter 10.82, addressing motor-assisted scooters, electric bicycles, and GPS-equipped bicycles, which has reportedly been amended to set up a vendor-selection process for dockless scooter operators. Secondary reporting describes a downtown business-district sidewalk ban, but the specific ordinance text could not be extracted from the city's document portal this session, so that detail is not confirmed here. Riders in Cheyenne should check the current municipal code directly.
