Wisconsin E-Scooter Laws: Sidewalk, Helmet & Age Rules (2026)

Are e-scooters legal in Wisconsin?

Yes. Wisconsin gives electric scooters their own defined vehicle category rather than folding them into an existing class like mopeds or bicycles. The definition and operating rules were created together by 2019 Wisconsin Act 11 and now sit across several sections of chapters 340, 346, and 349 of the Wisconsin Statutes.

The operating framework is built around a default: electric scooters may generally be used on roadways, bicycle ways, and sidewalks, with the state stepping back and letting municipalities and counties tighten that default locally where they choose to.

What counts as an e-scooter in Wisconsin

Wis. Stat. § 340.01(15ps) defines an electric scooter as a device that:

• Weighs less than 100 pounds
• Has handlebars and an electric motor
• Is powered solely by the electric motor and human power
• Has a maximum speed of not more than 20 mph on a paved level surface when powered solely by the electric motor

That 20 mph element is a design characteristic of the device, not a speed you are allowed to ride. What you may lawfully travel is set separately, at 15 mph, by § 346.94(18s)(c).

The definition specifically excludes electric personal assistive mobility devices (EPAMDs, the Segway-type category), motorcycles, motor bicycles, electric bicycles, and mopeds. Wisconsin's electric bicycle statute, § 346.806, is a separate law covering a different device; do not rely on it for scooter rules.

Where you can ride

Wisconsin is unusual among the states in this guide because sidewalk riding is the statutory default rather than the exception. Wis. Stat. § 346.805 states that, except where a specific carve-out or local ordinance applies, "a person may operate an electric scooter or an electric personal assistive mobility device upon any sidewalk," while yielding the right-of-way to pedestrians and bicyclists and giving an audible signal before passing.

The provision that actually authorizes scooter operation more broadly is § 346.94(18s), and § 346.805 is expressly made subject to it. Under § 346.94(18s)(a), a person may operate an electric scooter on any roadway, sidewalk, bicycle lane, or bicycle way that is under the jurisdiction of the department or that is open to the operation of bicycles. Paragraph (b) extends the same permission to those under a local authority's jurisdiction, subject to any restriction or prohibition set by municipal ordinance enacted under § 349.237.

The speed limit is 15 mph everywhere, not 20. Section 346.94(18s)(c) provides that no person may operate an electric scooter upon any roadway, sidewalk, bicycle lane, or bicycle way at a speed in excess of 15 miles per hour, and § 346.803(4) sets the same 15 mph ceiling on a bicycle path. Bicycle paths are therefore not held to a stricter speed limit than roadways; the number is the same on both.

On roadways, § 349.237 lets a municipality or county restrict or prohibit electric scooter operation on any road posted above 25 mph, so a scooter that is legal to ride on one street may not be permitted on a faster arterial a few blocks over, depending on local ordinance.

Rider rules

• Age: No statewide minimum age requirement for electric scooters was located in the sections researched for this page. Wisconsin's electric bicycle statute does set an age floor for its highest-powered e-bike class, but that rule does not carry over to electric scooters under a separate definition. Riders and parents should still check current Wisconsin DOT guidance or a specific city's ordinance, since the absence of a state age rule does not rule out a local one.
• Helmet: No statewide helmet requirement for electric scooters was located in the sections researched. As with age, this is an absence in the state statute rather than a blanket "no helmet needed anywhere" guarantee, since a municipality could layer its own rule on top.
• Lights and brakes: Wisconsin does impose statewide equipment duties, and they are easy to miss. Under § 347.489(1), an electric scooter ridden on a highway, sidewalk, bicycle lane, or bicycle way during hours of darkness must be equipped with a lamp emitting a white light visible from at least 500 feet to the front, plus a red rear reflector visible from 50 to 500 feet when lit by a car's headlamps, or a red flashing rear lamp visible from 500 feet instead of the reflector. Section 347.489(2) separately requires a brake in good working condition, adequate to control and stop the scooter, on a highway, bicycle lane, or bicycle way.
• License, registration, insurance: None of these were found as a requirement for operating an ordinary electric scooter under Wisconsin's scooter statutes.
• Local rental rules: § 349.237 specifically allows a municipality or county to regulate or restrict short-term commercial rental of electric scooters to the general public, separately from private ownership. A city that hosts a shared-scooter program can set its own rules for that program on top of the baseline state framework.

Penalties

A violation here is a forfeiture, a civil traffic penalty rather than a criminal fine. For the sections this page is mainly about, the amount is capped by statute: § 346.82(1) provides that a person violating §§ 346.80 to 346.807 may be required to forfeit not more than $20, and that range covers both the sidewalk rule in § 346.805 and the bicycle way rules in § 346.803.

That $20 ceiling does not cover everything a rider can be cited for. A citation written under a different provision, such as the 15 mph speed cap in § 346.94(18s), or under a local ordinance adopted under § 349.237, carries its own penalty amount, and court costs and surcharges are added on top of any forfeiture. Check the citation itself to see which provision you were actually charged under, and the issuing municipality's current fine schedule for a local ordinance violation.

Enforcement in practice

No statewide enforcement data specific to electric scooters was located for this research. Local reporting suggests some Wisconsin cities, including Milwaukee, restrict sidewalk riding in parks, school grounds, and certain downtown or riverfront areas more tightly than the state default allows, but the underlying municipal ordinance text was not independently verified in this research. Enforcement patterns, wherever they exist, do not change the underlying legal status of riding a scooter in a given location, and this page will not present unverified local figures as confirmed fact.

Milwaukee e-scooter rules

Milwaukee is Wisconsin's largest city and has hosted shared electric scooter programs. Reporting indicates Milwaukee restricts sidewalk riding more than the state's general default, including in parks, on school grounds, and along the Riverwalk, but the specific municipal ordinance text behind those restrictions was not independently confirmed in this research. Anyone riding in Milwaukee, whether on a private scooter or a rental fleet device, should check the current city ordinance or the rental operator's app directly rather than assuming the statewide sidewalk default applies unchanged everywhere in the city.
