Kentucky E-Scooter Laws: Sidewalk, Helmet & Age Rules (2026)

Are e-scooters legal in Kentucky?

Yes. Kentucky regulates standup electric scooters through a dedicated statute, KRS 189.289, titled "Operation of electric low-speed scooter on highway, bicycle lane, or bicycle path." It took effect June 27, 2019, and permits a person 16 years of age or older to operate an electric low-speed scooter on a highway, bicycle lane, or bicycle path, subject to Chapter 189's general traffic rules and KRS 189.520.

Kentucky law also maintains a separate statutory category called a "motor scooter" under KRS 189.2851, and it is genuinely important not to mix the two up. Where KRS 189.289 lightly regulates the everyday Bird- or Lime-type device, KRS 189.2851 covers a different, more heavily regulated class subject to titling, registration, insurance, and helmet requirements. That category is defined by specific hardware rather than by general impressions: KRS 189.2851(1) gives "motor scooter" the same meaning it has in KRS 186.010, whose subsection (24) requires a low-speed motorcycle equipped with wheels greater than 16 inches in diameter, an engine greater than 50 cubic centimeters, brake horsepower of two or greater, and a step-through frame or a platform for the operator's feet, designed to operate at a speed not to exceed 50 mph. A device does not become a "motor scooter" simply by having a seat or a higher top speed. If it falls outside the electric low-speed scooter definition below and does not meet those five elements either, it lands in Kentucky's moped, motorcycle, or motor vehicle rules rather than under KRS 189.2851.

What counts as an e-scooter in Kentucky

KRS 189.010(26) defines an "electric low-speed scooter" as a device that weighs less than 100 pounds; is equipped with wheels, handlebars, and a brake adequate to stop and park the device; is designed to be stood or sat upon; is propelled by an electric motor, human power, or both; and is designed to operate at a maximum speed of 20 mph on a paved level surface, with or without human propulsion.

Two details are worth flagging. First, the "stood or sat upon" language means the category is not limited to standup kick scooters: a seated device still qualifies so long as it meets the weight, wheel, handlebar, brake, motor, and 20 mph elements. Second, an electric low-speed scooter meeting this definition is excluded from Kentucky's general "motor vehicle" definition under KRS 189.010, which is the basis for the licensing, registration, and insurance exemptions described below.

Again, this definition is specifically for the lighter "electric low-speed scooter" category. The heavier "motor scooter" category is defined separately, by the five hardware elements of KRS 186.010(24) set out above, and it carries motorcycle-license, title, registration, insurance, and helmet obligations under KRS 189.2851. If your device meets those elements, read KRS 189.2851 directly or ask a Kentucky attorney before assuming the rules below apply to it.

Where you can ride

KRS 189.289(1) authorizes riding an electric low-speed scooter on a highway, a bicycle lane, or a bicycle path. The statute separately allows a scooter to be parked on a sidewalk, as long as the parked device does not impede pedestrian or other traffic, but that is a parking rule, not a general statement that sidewalk riding itself is authorized statewide. This research did not find an explicit statewide sidewalk-riding rule in KRS 189.289 one way or the other, so whether sidewalk riding is allowed in a given place is likely to depend on local ordinance, covered further in the Louisville section below.

Rider rules

• Age: 16 or older, stated directly in KRS 189.289(1).
• Helmet: No statewide helmet requirement exists, and this is by explicit statutory design. The law requires the Kentucky Transportation Cabinet to set safe-operating standards by regulation, but specifically states those standards "shall not include any equipment or helmet use requirements." Kentucky has affirmatively barred its own transportation agency from creating a helmet mandate for these scooters.
• License, registration, insurance: None of these are required. An electric low-speed scooter is excluded from Kentucky's statutory "motor vehicle" definition, and KRS 189.289 does not itself impose a license, registration, or insurance requirement.
• Equipment: A headlamp and a rear red light are required, lit from half an hour after sunset to half an hour before sunrise, and during any other period of low visibility.
• Local compliance: Both individual riders and any rental company operating scooters must comply with all applicable local ordinances, under KRS 189.289(5).

Penalties

This research did not locate a specific, itemized penalty schedule tied to KRS 189.289 violations. Because the statute subjects electric low-speed scooters to Chapter 189's general traffic regulations, a violation could be handled as a general traffic offense, but no scooter-specific fine amount was found. Enforcement in practice

No statewide enforcement data specific to electric low-speed scooters was located for this research. Enforcement patterns, wherever they exist locally, do not change the underlying legal status described above and are not permission to ride outside it.

Louisville e-scooter rules

Louisville is Kentucky's largest city and has an active dockless shared-scooter market. Secondary sources describe a Louisville Metro ordinance banning sidewalk riding for both bicycles and scooters citywide for riders age 11 and up (with an all-ages restriction downtown), fines up to $50, and a permit structure for a limited number of dockless-vehicle operators.
