Are e-scooters legal in Malawi?

Malawi's Road Traffic Act, Chapter 69:01, never mentions scooters, kick-scooters, or personal mobility devices. Its answer instead comes from how broadly it defines "motor vehicle": any self-propelled vehicle. That phrase alone is wide enough to sweep in a battery-powered scooter without the legislature ever having had to think about one specifically.

The Act then narrows itself with a short list of exclusions, and one of them is the whole ballgame for e-scooters. A vehicle "propelled by electrical power derived from storage batteries" is carved out of the motor vehicle definition, but only if it is "pedestrian-controlled." Nothing in the statute defines that phrase any further.

The pedestrian-controlled question

This is the single clause that decides whether an e-scooter needs registration, a licence, and a helmet in Malawi, or needs nothing at all. Read narrowly, "pedestrian-controlled" describes a device a person walks alongside or behind while steering it, the way someone pushes a powered wheelbarrow or a walk-behind cart. Under that reading, a rider who stands on the deck of a scooter and rides it is not a pedestrian controlling anything; they are operating a vehicle, and the exclusion does not reach them.
