How do I apply for child support in Hawaii?

You can apply through three agencies. Contact the Child Support Enforcement Agency (CSEA) at ag.hawaii.gov/csea to request an application, file a petition with the Hawaii Family Court at courts.state.hi.us, or go through the Office of Child Support Hearings (OCSH). All three have authority to establish and enforce child support orders. CSEA has branch offices on Oahu, Maui, the Big Island, and Kauai.

What is the minimum child support payment in Hawaii?

Under the 2024 Hawaii Child Support Guidelines (effective April 1, 2024), the minimum child support amount is $91 per child per month. Courts generally cannot order less than this amount unless an exceptional circumstance applies; the guideline worksheet also protects an after-tax self-support amount of $1,693 per month for each parent.

Can child support extend beyond age 18 in Hawaii?

Yes. Under HRS 580-47, child support may continue until age 23 if the child is enrolled full-time (12 or more credit hours per semester) in an accredited post-high school university, college, or vocational school. Support may also continue indefinitely for children with mental or physical disabilities that prevent self-support. CSEA will send a notice three months before the child's 19th birthday requiring proof of enrollment to continue payments.

How often can I request a child support modification in Hawaii?

You have the right to request a review and adjustment of your child support order once every three years without proving a change in circumstances. Outside that three-year cycle, you can petition for modification at any time by demonstrating a substantial and material change, such as a significant income change, job loss, or change in custody arrangements. A material change is presumed if the recalculated amount differs by 10% or more from the current order.

Does remarriage affect child support obligations in Hawaii?

No. Hawaii specifically excludes remarriage as a basis for modifying child support. A new spouse's income is not factored into the child support calculation, and remarriage alone does not qualify as an exceptional circumstance that would justify a deviation from the guidelines. The support obligation is based solely on the biological or legal parents' incomes and the child's needs.

How Hawaii Calculates Child Support

  • Hawaii uses the Melson Formula, one of only two states (with Delaware) currently using this model. Montana previously used it but has transitioned to Income Shares.
