How Delaware Calculates Child Support

  • Delaware uses the Melson Formula, a three-step model named after Judge Elwood F. Melson Jr.
  • Step 1: Each parent's self-support allowance ($1,600/month) is deducted first, ensuring both parents can meet their own basic needs.
  • Step 2: The primary child support need ($800 for the first child, $420 for each additional) is divided between parents proportional to their available income.
  • Step 3: A Standard of Living Adjustment (SOLA) gives children a share of each parent's remaining income (12% for 1 child, 17% for 2, 21% for 3).
  • A high-income offset applies when either parent's income available for SOLA exceeds $16,000 — 30% of the excess is subtracted before applying the SOLA percentage.
  • Delaware is one of only two states currently using the Melson Formula (along with Hawaii). Montana previously used it but has since transitioned to Income Shares.
  • Values are updated annually based on federal poverty guidelines, effective February 1 of each year.
