How Alabama Calculates Child Support

  • Alabama's guidelines run on ADJUSTED GROSS income: income taxes and FICA are never subtracted. The only adjustments to gross income are items like court-ordered child support or maintenance a parent actually pays for other cases. Enter income before taxes.
  • Alabama uses the Income Shares model under Rule 32 of the Alabama Rules of Judicial Administration, considering both parents' adjusted gross incomes.
  • The basic child support obligation is determined from a schedule table based on combined adjusted gross income and number of children.
  • Each parent's share is proportional to their percentage of the combined income.
  • A visitation adjustment applies when the noncustodial parent has the children overnight for 92 or more nights per year (approximately 25% of the time), per Rule 32(B)(8).
  • Health insurance premiums and work-related childcare costs are added to the basic obligation and divided proportionally between parents.
  • Adjusted gross income includes all income from any source, minus pre-existing child support obligations and federal income tax.
  • Courts may deviate from the guidelines upon a written finding that application would be unjust or inequitable (Rule 32(A)(2)).
