Are e-scooters legal in Oregon?

Yes. Oregon regulates e-scooters, which the statute calls "motor assisted scooters," as their own defined vehicle class. The definition sits at ORS 801.348, and the operating rules run from ORS 814.510 through ORS 814.536.

ORS 814.510 gives motor assisted scooter operators the same rights and duties as any other vehicle operator on the road, except where a provision by its nature cannot apply or where the code carves out a specific exception, such as the age, speed, and helmet rules covered below. This statewide framework applies to privately owned scooters everywhere in Oregon; the research for this article did not find a separate rental-specific legal regime, so shared scooters operating in cities like Portland follow the same state rules as a baseline, with cities free to add their own program terms for the companies they permit.

What counts as an e-scooter in Oregon

ORS 801.348 defines a motor assisted scooter as a device with no more than four wheels, a foot support or seat for the rider, that can be propelled by a motor or by human power, or both. The power source itself has to be incapable of moving the scooter faster than 24 mph on level ground; an electric motor is capped at 1,000 watts of power output, and a combustion engine at 35 cubic centimeters or less.

That 24 mph figure describes what the device is allowed to be built to do, not what a rider is allowed to actually do with it on a public street. The operating speed limit, covered below, is lower.

Where you can ride

ORS 814.512 sets the operating speed limit at 15 mph. A rider who exceeds that speed, on a highway or on premises open to the public, commits the offense of unlawful operation of a motor assisted scooter, the same offense that covers riding under age 16.

Sidewalk riding is addressed separately at ORS 814.524, which makes it an offense except when entering or leaving adjacent property. The statute also flags specific unsafe conduct near sidewalks and crosswalks, including sudden movements into the path of another vehicle, failing to give an audible warning before passing a pedestrian, failing to yield, and moving faster than a walking pace near a crosswalk or driveway.

ORS 814.516 separately addresses motor assisted scooters in state parks, though the full text of that section was not opened for this article; riders planning to use a scooter inside an Oregon state park should confirm the current rule with the park directly rather than assume the general roadway rules apply unchanged.

Rider rules

The minimum age is 16, stated as a hard numeric floor at ORS 814.512, unlike some states that key the age requirement to a driver's license instead. The license exemption itself lives in a different chapter rather than in the age and speed section. ORS 807.020(16) provides that a person may operate a motor assisted scooter without a driver license or driver permit if the person is 16 years of age or older. The exemption is therefore express rather than inferred from silence, and it carries the same age condition as the operating rule: a rider 16 or older needs no license, and a rider under 16 cannot ride legally under ORS 814.512 whether they hold a license or not.

Oregon's helmet rule is the state's most distinctive feature in this cluster. ORS 814.534(1) requires anyone operating a motor assisted scooter on a highway or on premises open to the public to wear protective headgear approved under ORS 815.052, and the section carries no age qualifier of any kind, only a religious-belief exemption. This means Oregon's helmet law covers every rider, not only minors, a genuine departure from the under-18 pattern common in neighboring states. If you have seen an "under 16" or "minors only" description of Oregon's helmet law elsewhere, that description does not match the statute's own text. The presumptive fine for a first helmet violation is $25, and it can be waived if the rider shows they own an approved helmet.

Penalties

Unlawful operation under ORS 814.512, which covers both the under-16 age violation and exceeding the 15 mph speed limit, is a Class D traffic violation. Failure to wear approved headgear under ORS 814.534 carries a presumptive fine of $25, waivable on a first offense if the rider can show they own qualifying headgear. Sidewalk riding under ORS 814.524 is also a traffic offense; the sections reviewed for this article did not include a specific dollar figure for that violation.

Enforcement in practice

No statewide e-scooter enforcement statistics were located for this article. Portland's transportation bureau documents its own program rules but not a separate set of enforcement figures for the sidewalk ban or helmet requirement.

Enforcement patterns do not change what the statute requires. Seeing riders without helmets, including adult riders, is not evidence that Oregon's helmet law is limited to minors; ORS 814.534's own text applies to everyone, whatever the visible enforcement pattern looks like on a given street.

Portland e-scooter rules

Portland's Bureau of Transportation states plainly that using an electric scooter on the sidewalk and in crosswalks is prohibited, matching the state default under ORS 814.524. PBOT also states that people using electric scooters are required to wear a bicycle helmet, consistent with Oregon's all-ages helmet law rather than a separate, stricter city rule.

Riders must lock a scooter to a public bike rack or a city signpost if no rack is available when parking. Riding is not allowed in Portland city parks except on park roads or in areas specifically designated for it. Portland's shared-scooter program, run through permitted operators, caps shared-scooter speed at 15 mph to match the state limit and does not allow shared-scooter riding on Central City sidewalks.
