Does Colorado Have an Age Verification Law? (2026 Update)

As of August 2026, Colorado has not enacted a law requiring pornography websites to verify a visitor's age. Two separate attempts, a statute and a proposed constitutional amendment, both failed in 2025 and 2026, and Colorado's only enacted law aimed at online age checks instead pushes those checks to the device level rather than to individual websites.

Two Failed Attempts at a Website-Level Law

Colorado's Senate Bill 25-201, Require Age Checks for Online Sexual Materials, was introduced March 20, 2025 with bipartisan sponsorship. It passed out of committee, and was laid over on the Senate's second reading calendar in a sequence of dates: April 1, April 4, April 10, and April 14, before landing on May 8, 2025, the final day of the 2025 session under Colorado's constitutional 120-day limit. It was never called for a floor vote before the General Assembly adjourned sine die that same day. The bill's own status page records its final status as Lost. Both the bill's sponsors and the Governor's Office of Information Technology pointed to the then-pending Supreme Court case Free Speech Coalition v. Paxton as a reason to hold the bill for a later session; the Office separately opposed it on privacy and litigation-cost grounds.

A different approach followed in 2026. House Concurrent Resolution 26-1002 would have asked the General Assembly to refer a constitutional amendment to Colorado voters requiring the state to mandate age verification for distributors of pornographic material. Rather than a direct statute, this was a ballot-measure route. The House State, Civic, Military and Veterans Affairs Committee postponed it indefinitely on April 13, 2026, by a 7 to 4 vote, so it never reached voters. Its status is also recorded as Lost.

Colorado's Enacted Law Takes a Different Approach: the Device Level

After both 2025-2026 attempts at a website-level age-verification statute failed, Colorado enacted a different kind of law. Senate Bill 26-051, Age Attestation on Computing Devices, was signed by the Governor on June 3, 2026 and appears as Chapter 343 of the 2026 session laws. Section 2 of the act adds article 30 to title 6 of the Colorado Revised Statutes, titled Age Attestation for Online Users and codified at C.R.S. 6-30-101 to 6-30-105. The operative duty sits at C.R.S. 6-30-102, which requires an operating system provider that runs or preinstalls a covered application store to provide an accessible interface at account setup for indicating the user's birth date, age, or age bracket, and to give developers a real-time interface for requesting that age signal. It requires computing devices to offer an interface where a user can attest to their age, generating a signal that app developers can rely on, the same device-level, operating-system model that California's AB 1043 and Illinois's Public Act 104-0664 use.

Device age-signal interfaces are required by July 1, 2028. For pre-existing accounts and apps updated on or after July 1, 2027, developer duties phase in by January 1, 2029. Civil penalties reach up to $2,500 per child for a negligent violation or $7,500 per child for an intentional one, enforced by the Colorado Attorney General.

This is not a requirement that a pornography website itself check a visitor's ID or age before granting access. It shifts the age signal to the device and the app, not to the website.

Where This Leaves Colorado Residents

No federal law requires adult websites to verify a visitor's age. The Supreme Court's 2025 decision in Free Speech Coalition v. Paxton confirmed that a state may enact a website-level verification requirement and have it survive a First Amendment challenge, but it does not require any state to do so, and Colorado, after two failed attempts, has instead moved to the device-signal model described above.

Because Colorado has no statute requiring adult websites to verify visitors directly, mainstream adult websites generally do not geo-block Colorado visitors the way some have blocked residents of Texas, Louisiana, Utah, and other states with an enacted website-level requirement.
