Wyoming Adoption Records: Original Birth Certificates and Sealed Files

Wyoming sits at the closed end of the national spectrum for adoption records. There is no age-based self-service right for an adult adoptee and no mutual-consent registry. Every path to the sealed original birth certificate and the adoption court file runs through a court order, though Wyoming does codify a Confidential Intermediary program that can search for a biological relative on a court-appointed basis, a narrower alternative to filing a full sealed-record petition.

Can an Adult Adoptee Get an Original Birth Certificate in Wyoming?

No, not without a court order, and Wyoming does not carve out an exception for an adult adoptee the way most other states do. Wyoming's vital-records statute provides that 'If a new certificate of birth is issued under this section, and in the case of adoptions, the original certificate of birth and evidence of adoption shall not be subject to inspection except upon order of a court of competent jurisdiction' (Wyo. Stat. 35-1-417(b)). There is no age threshold, no birth-parent-consent alternative, and no registry-match alternative anywhere in the statute. Every requester, including the adoptee themselves, has to go through a court.

The condition at the front of that sentence is worth understanding. The inspection bar engages where a new certificate of birth was issued, and Wyo. Stat. 35-1-417(a)(i) provides that 'a new certificate of birth shall not be established unless so requested by the court decreeing the adoption, the adoptive parents or the adopted person.' In the ordinary case a new certificate is requested and the original record is sealed behind it, which is why the court-order rule is the practical reality for almost every Wyoming adoptee. Where no new certificate was ever requested after the adoption, though, this subsection's inspection bar by its own terms does not engage, and the original certificate is not sealed by this section. That situation is uncommon, and the adoption court file stays separately sealed either way, but an adoptee with reason to think no amended certificate was ever issued should raise that point directly with Vital Statistics Services.

The Adoption Court File and the Good-Cause Standard

Wyoming's adoption statute separately seals the underlying court file: 'upon the entry of the final decree of adoption, all records in the proceedings shall be sealed and may be available for inspection only by order of court for good cause shown.' Wyoming's version of the good-cause standard is notably framed around the child rather than around the adoptee's own interest in the information. The court must additionally find that 'the welfare and best interests of the child will be served' before ordering the file opened, a more child-centered standard than the adoptee-autonomy language used in many other states' statutes. The statute also includes a specific carve-out addressing the Wyoming Indian Child Welfare Act, relevant where a tribal child's adoption is involved.

No Mutual-Consent Registry, But a Confidential Intermediary Program Exists

Wyoming does not maintain a mutual-consent registry of the kind found in states like Washington or West Virginia, where birth parents and adoptees can each file a matching consent. Wyoming does, however, codify a separate Confidential Intermediary program at Wyo. Stat. 1-22-201 through 1-22-203, within the same Title 1, Chapter 22 as the adoption-sealing statute above.

A confidential intermediary is defined as a person 21 or older who has completed a training program and is authorized to inspect confidential relinquishment and adoption records. An adult adoptee, adoptive parent, biological parent, biological sibling, or biological grandparent, 18 or older, may file a motion with a supporting affidavit in the court that handled the adoption, or the court that terminated parental rights, asking the court to appoint one or more confidential intermediaries to locate an unknown biological relative. Minors cannot be the subject of that search. The court may rule on the motion without a hearing. Once appointed, the intermediary is authorized to inspect 'confidential relinquishment and adoption records,' and Wyo. Stat. 1-22-203(a)(i) frames that access as occurring 'as ordered by the court, upon motion.' Wyoming's statute stops there: it does not extend an intermediary's reach to hospital records or to birth, marriage, divorce and death records the way some other states' confidential-intermediary laws do. Contact between the parties happens only once both sides have given written consent filed with the court; without that mutual consent, the records go back to the court and stay confidential.

This is still a court-gated process, so it does not give a Wyoming adoptee the kind of direct, no-court-order access available in states like South Dakota. But it is a narrower, purpose-built motion aimed at locating a specific relative, rather than the broader sealed-record petition described above, and it is a real, standing alternative that a Wyoming adoptee or birth parent should know exists.

How to Request Sealed Adoption Records in Wyoming

Wyoming's Department of Health, Vital Statistics Services administers adoption-related vital records. Based on independently corroborated public information, since the department's own adoption pages could not be directly reached for this article:

• Forms: the Wyoming Report of Adoption; the Request for Birth Certificate Following Adoption (Form 1b); a Request for Foreign Born Birth Certificate Following Adoption; and, for the sealed original record specifically, an Application to Open Sealed Adoption File (with a separate tribal-enrollment version).
• Ordinary post-adoption certificate fee: reported at $55.00, payable to Vital Statistics Services by personal check or money order (no third-party checks), requiring a certified copy of the final decree and the Wyoming Report of Adoption; additional copies reported at $25.00 each.
• Office: Wyoming Department of Health, Vital Statistics Services, 2300 Capitol Avenue, Hathaway Building, Cheyenne, WY 82002.
• Sealed file process: to access the sealed, pre-adoption record specifically, a court order from the court that granted the adoption, a Wyoming District Court, or a federal court is required, specifying exactly which documents may be released and to whom.

Non-Identifying Information

Wyoming has a dedicated statute on this, and it is the one route on this page that does not necessarily run through a court. Wyo. Stat. 1-22-116 provides that, to the extent available, the medical history of an adopted child and his natural parents, 'with information identifying the natural parents eliminated,' shall be provided by an authorized agency, or may be provided by order of a court, to the adoptive parent any time after the adoption decree, or to the adopted person after he attains the age of majority. The court-order route is offered there as an alternative method of delivery, not as the only door.

The statute also sets a floor on what the history has to contain rather than leaving it to agency discretion. It must include all available information on conditions or diseases believed to be hereditary, any drugs or medication the natural mother took during pregnancy, and any other information that may be a factor influencing the child's present or future health. The Wyoming Department of Family Services promulgates the rules governing release under this section, so that department, rather than Vital Statistics Services, is the place to start a medical-history request. Note the limit on what this delivers: medical and health background with identifying details stripped out, not the sealed original birth certificate and not the adoption court file, both of which still require a court order.

Finding Birth Parents in Wyoming

Because Wyoming offers no self-service track and no mutual-consent registry, a court process is the structural path for a Wyoming adoptee or birth parent hoping to connect, either the full sealed-record petition or the narrower Confidential Intermediary motion described above, a meaningfully higher bar than in most states.
