Wisconsin Adoption Records: Original Birth Certificates and Sealed Files

Can an Adult Adoptee Get Their Original Birth Certificate in Wisconsin?

Yes, but release usually depends on matching consent, not just on the adoptee's request. Wisconsin Statutes 48.433 sets up a mutual-consent-affidavit model built directly into the access statute, rather than a separate court-order requirement. Any eligible person 18 or older may request the record, but the department 'shall disclose the requested information... in either of the following circumstances: (a) [the department] has on file unrevoked affidavits filed under sub. (2) from both birth parents,' or '(b) one of the birth parents was unknown... and the known birth parent has filed an unrevoked affidavit.' Functionally, this operates like a registry match, even though it is administered by the department rather than branded as a separate registry.

Consent affidavits are not the only route to the certificate. Under Wisconsin Statutes 48.433(8)(a), if both birth parents are known to be deceased, the department 'shall provide the requester with his or her original birth certificate,' with no affidavit involved, and if only one birth parent is known to be deceased, the department releases the original birth certificate where the other birth parent has filed an unrevoked affidavit. Wisconsin Statutes 48.433(7)(e) supplies a further route: if a known birth parent cannot be located after the department's diligent search, the department may disclose the requested information where the other birth parent has filed an unrevoked affidavit.

The 1982 Date Limit Only Gates One of Two Paths

A detail worth stating precisely, because it is easy to misread: the February 1, 1982 date reference in the statute applies to only one of Wisconsin's two eligibility pathways, the narrower one covering an adoptee 'adopted... with the consent of his or her birth parent or parents before February 1, 1982.' The other, much more commonly used pathway, covering an adoptee 'whose birth parent's rights have been terminated in this state,' carries no date restriction at all and covers the large majority of standard modern Wisconsin adoptions, which proceed through a formal termination of parental rights (TPR) rather than a simple pre-1982 consent adoption. Wisconsin's Adoption Records Search Program is not limited to older, pre-1982 adoptees; it is available to adult adoptees from TPR-based adoptions finalized at any date.

The Court File and the Good-Cause Standard

The underlying court records are governed by Wisconsin Statutes 48.93: 'all records and papers pertaining to an adoption proceeding shall be kept in a separate locked file and may not be disclosed except under sub. (1g), (1r), (1v), or (1w), s. 48.432, 48.433, 48.434, 48.48 (17) (a) 9. or 48.57 (1) (j), or by order of the court for good cause shown.' Wisconsin's Adoption Records Search Program

Wisconsin's affidavit-matching mechanism is administered by the Department of Children and Families as the "Adoption Records Search Program," using application form DCF-P-PSF0005A. As of August 2026:

• Fee: $40.00, nonrefundable, though waivable or reducible for financial hardship on request.
• Who can apply: an adult adoptee (18 or older), an adult whose birth parent's rights were terminated in Wisconsin, an adoptive parent, a guardian or legal custodian, an adult offspring of an adoptee, a parent or guardian of a minor offspring of a deceased adoptee, or an assigned agency or social worker. Siblings, spouses, and other relatives are explicitly NOT eligible to apply.
• Identifying-information gate: available only once all known birth parents have provided a notarized affidavit consenting to release, or are deceased.
• Birth-parent role: current Wisconsin law does not let a birth parent initiate a search request on their own. A birth parent may only ask the program to locate their child for urgent medical or genetic reasons with a licensed provider's written statement, file a consent affidavit in advance, or revoke a previously filed affidavit.

Note that this Search Program is separate from an ordinary, non-adoption amended birth certificate, which Wisconsin Vital Records issues for a standard $20 filing fee. The Search Program is specifically for the sealed original birth certificate and identifying information; do not conflate the two products when planning a request.

Non-Identifying Information

Wisconsin's DCF program materials make non-identifying information available to a broader set of applicants than identifying information requires. Detailed non-identifying document categories, including case notes, medical, dental, and psychiatric information, birth records, educational materials, medical and genetic history, legal documents, and letters, are available to all eligible applicant categories, with names, dates, and contact information redacted.
